Olivier Martinez and Gabriel Aubry get into a brawl at Halle Berry's home when he drops Nahla off for Thanksgiving.
Apparently it was Aubry who was taken to the hospital and a citizen's arrest was made. Halle has an emergency restraining order against him for her, Martinez, and Nahla.

With the way the custody battle has been going, I'm surprised Halle and Gabriel apparently aren't (or weren't) at the "have a third party hand off the kid from one parent to another" stage. Where was the nanny? Didn't a judge rule against Halle moving to France with Nahla earlier this month? I hate to say that anyone was provoked into violence but what...interesting timing for Halle that Gabriel "proves" how violent he is and that he can't be trusted around his daughter. And maybe in light of this new evidence a judge will now decide that Halle can move out of the continent with their daughter after all, just like she wanted in the first place. That Yahoo link said all three adults and Nahla involved went to a party together a few days ago without incident, which is frankly shocking to me. Now this. Maybe if TMZ didn't have pictures of Olivier's injuries already it would all feel a little less like a setup. Of course, even if someone is egged on into a fight, that doesn't mean that reacting with violence is the only available option. Maybe Halle was right about Gabriel all along but no one would believe her and that was extra infuriating and she wondered what she had to do to get people to see things her way. Or, the reality could be that all the adults involved here suck to varying degrees. Poor Nahla!

The original article I saw stated that Martinez came out of the house to talk to Aubry and that's when the fisticuffs started. It didn't say who started the fight. Why wouldn't Martinez have stayed in the house? It makes me wonder if he was trying to fan flames.
This child appears to have a loving father who wants to be in the picture. I was happy to hear the judge put the kibosh to the move to France and I hope this incident doesn't cause Aubry to lose access. He doesn't seem like a loser. As far as I know there's been no history of violence with this guy.
I feel sorry for Nahla, though, and hope she didn't see any of this go down.

Considering too that the injuries are apparently to his hand, that doesn't really help or hurt their case. It just confirms he was in a fight, it doesn't really do a good job of showing him to be the victim of anything. Because you can hurt your hand by, you know, punching someone, regardless of who started it.
It's a shame when grown-ups can't be fucking grown-up in their child rearing. I haven't heard anything about him being a bad father, so I lean towards "Halle, you chose to have a child with him and thought he was good enough then - absent new information, yes, you do need to share".

Apparently they were yelling at each other in French before/while fighting, so it's unlikely even witness know exactly what happened. I didn't realize that Nahla's father was also a French speaker (he's French-Canadian).
Poor kid. I echo whoever said they wondered why the parents were near each other after such a nasty custody battle (trying to move the kid across the world is pretty much trying to end her relationship with her dad).

Whoever started the fight, Aubry's bashed face suggests Martinez won it. I wouldn't be surprised if, in addition to the restraining order, charges get fired against Martinez, too.
